House Bill 309 was recently filed at the Texas Legislature. Some are calling it a “win” for hemp, but the truth is very different. HB 309 would hurt small businesses, limit consumer choice, and push Texas further behind in the hemp economy.
What HB 309 Proposes
While the bill reiterates that hemp products with no more than 0.3% Delta-9 THC remain legal under federal law, it also introduces damaging restrictions:
Bans retail sales of natural hemp flower and pre-rolls — even if fully compliant with the Farm Bill.
Continues the ban on manufacturing smokable hemp products in Texas, driving jobs and innovation to other states.
Imposes new costs on small businesses through expanded lab testing, labeling, and compliance requirements.
Why This Hurts Texas
HB 309 doesn’t strengthen hemp — it undermines it.
Retailers lose one of their most in-demand product categories.
Farmers lose direct markets for their hemp flower.
Consumers lose access to safe, lab-tested products they rely on.
Communities lose jobs, tax revenue, and economic opportunity.
This bill restricts rather than supports a legal, compliant, and growing Texas industry.
What Texas Needs Instead
If lawmakers are serious about protecting Texans, the focus should be on transparency, testing, and accountability — not prohibition. Texas should be building a hemp program that supports small businesses, strengthens consumer trust, and positions our state as a national leader in hemp innovation.
Take Action Now
HB 309 has only just been filed. That means there is still time to make changes — but it requires your voice.
Call your State Representative today. Tell them:
HB 309 must be amended.
A retail ban on hemp flower and pre-rolls will devastate small Texas businesses.
Consumers deserve access to safe, tested, compliant hemp products.
Texas should be growing jobs and innovation, not banning them.
The future of Texas hemp is being decided right now. Let’s make sure lawmakers hear from the people who will be most affected.
