Right now, the Texas hemp industry is sitting in cannabis purgatory.


We’re all waiting for the Texas Department of State Health Services (DSHS) to release the next version of the consumable hemp rules tied to our licenses. The rumor mill is spinning out of control, but I’m not going to sugarcoat it, I saw this coming from the beginning.


Let’s be honest about what’s happening here.


DSHS is expected to move toward a Total THC standard, which would effectively wipe out the THCA market overnight, especially flower and pre-rolls. That’s not speculation. That’s the direction the regulatory pressure has been heading for years.


SB3. The veto. New rules.


Let’s call it what it was: political theater.


What we’re seeing now is a deliberate, sequenced chain of events targeting THCA flower and anything smokable.


The fun police have arrived.


And Now They Want to Take Away the Pre-Rolls Too


Let’s zoom out for a second.


The world feels like it’s going a little sideways right now. Wars popping up, the economy bouncing around, people stressed, trying to make a living, trying to keep their businesses alive.


And somehow, in the middle of all of that, the priority becomes…


Taking away hemp pre-rolls and flower.


Really?


That’s what we’re doing?


Texas has decided that while the world is in unrest, we should focus on eliminating THCA flower and smokable hemp products, something that thousands of small businesses built their livelihoods around under the rules the state itself created.


It’s hard not to see the irony.


At a time when people could probably use a little bit of relaxation and common sense policy, the regulators have decided to double down on prohibition-lite.


The fun police are back, and apparently pre-rolls and flower are the enemy.


But here’s the thing they may not fully understand.


This industry isn’t just a trend. It’s farmers, retailers, manufacturers, veterans, entrepreneurs, and consumers who built something real under the framework the federal government created in 2018.


And we’re not going anywhere.


So What Do We Do?


First, we don’t throw in the towel.


Second, we recognize that we’re likely going to spend some time here in cannabis purgatory while the legal battles play out.


There are already strong organizations preparing lawsuits, and once those are filed, the courts will slow everything down. If we’re lucky, litigation will buy the industry time.


As long as the federal landscape doesn’t shift toward a full prohibition scenario, the Texas market may continue operating in that gray zone for a while longer.


But make no mistake, if the federal government moves toward a ban, regulators could use emergency rulemaking to implement Total THC overnight and shut the THCA market down.


So while we’re stuck in purgatory, this is the time to get your house in order.


That means:


Tight inventory controls

Products that actually match their COAs

Consumer-safe packaging and labeling

Documentation that proves compliance

Staff training and operational standards


All the things responsible businesses should have been doing anyway.


Because if enforcement ramps up, and it very well might, you can bet Lt. Dan and his DPS cronies won’t hesitate to come knocking.


And they won’t be knocking politely.
